1. Scope of Services
Arcus Dein LLC (“Arcus Dein,” “we,” “us,” “our”) provides digital architectural design files, drawings, and related materials through arcus-dein.com
All deliverables are conceptual design documents, not stamped, sealed, or permitted construction drawings.
Purchases through this Site constitute a license to use, not a transfer of ownership.
1.1 Service Categories
(a) Custom Services: Comprehensive architecture and interior design
through individual written agreements. Includes spatial planning,
architectural drawings, interior specifications, material selections,
finish coordination.
(b) Collection Plans: Pre-designed architectural drawings and spatial
planning available through this website. Includes floor plans,
elevations, sections, site planning. Does NOT include interior
design services, finish specifications, furniture planning, or
fixture selections.
These Terms govern Collection Plans only. Custom Services are subject
to separate agreements.
2. Acceptance of Terms
By accessing or purchasing from this Site, you confirm that you:
- Have read, understood, and agreed to these Terms.
- Are 18 years or older and legally authorized to enter binding agreements.
If you disagree, do not use the Site or its materials.
By purchasing or downloading any digital materials, you acknowledge and agree to be bound by this Terms of Service, our Refunds & Exchanges Policy, Licensing Terms, and Export & Arbitration Notice. Each of these policies forms part of this Agreement and governs your purchase and use of Arcus Dein materials.
Order of Precedence
In event of conflict between documents:
1. Licensing Terms (defines license scope)
2. Terms of Service (general use)
3. Export & Arbitration Notice (disputes)
4. Refund Policy (refund conditions)
5. IP Disclaimer (IP details)
6. Privacy Policy (governed by GDPR/CCPA)
7. Legal Disclosures (supplemental)
3. Intellectual Property Rights
All designs, plans, images, text, and digital files remain the sole property of Arcus Dein LLC.
Unless otherwise agreed in writing, no copyright or ownership transfer occurs.
Clients receive a non-exclusive, non-transferable license for use in accordance with the Licensing Terms for Digital Plans, which define Single-Use, Multi-Use, and Unlimited-Use categories.
Purchases grant only a single-project evaluation license; reuse for multiple projects requires additional licensing.
Reproduction, resale, or redistribution without written consent is strictly prohibited.
Arcus Dein may embed invisible identifiers in downloadable files to track unauthorized redistribution.
Nothing herein grants implied rights to reuse for construction or permits.
4. Orders & Payment
All prices are listed in U.S. Dollars (USD).
Payment is processed securely through Shopify or approved third-party processors.
Arcus Dein reserves the right to reject any order suspected of fraud or policy violation.
By placing an order, you authorize Arcus Dein to collect payment for the total amount shown at checkout.
5. Licensing & Use Restrictions
You may use purchased files for reference or internal design coordination only.
You may not:
- Modify or alter digital files for sale or distribution, except as expressly permitted in Licensing Terms (e.g., licensed professional modifications for code compliance with prior written authorization).
- Use materials for construction permits or engineering submittals.
- Claim ownership or remove Arcus Dein identifiers.
- Resell or license derivative works based on Arcus Dein materials.
6. Refunds & Exchanges
Due to the digital nature of our products, all sales are final once files are delivered.
In accordance with the Refund & Exchanges Policy, case-by-case exceptions may apply (e.g., duplicate transactions).
7. Privacy & Cookies
Your use of the Site is governed by our Privacy Policy, which explains how personal data is collected, used, and protected.
8. Export Compliance
All downloads are subject to U.S. export laws and regulations.
Users outside the United States are responsible for ensuring compliance with their local import laws.

9. Disclaimers & Limitation of Liability
Arcus Dein makes reasonable efforts to ensure accuracy in all materials, but drawings are conceptual only.
All services and digital products are provided “as is,” without express or implied warranty.
Arcus Dein shall not be liable for any indirect, incidental, or consequential damages arising from use or misuse of materials.
Force Majeure
Arcus Dein not liable for delays due to causes beyond reasonable control, including: natural disasters, pandemic, war, government orders, internet failures, power outages. Performance suspended during such events.
10. Indemnification
You agree to indemnify and hold harmless Arcus Dein LLC, its officers, employees, and agents from any claims resulting from your breach of these Terms or unauthorized use of materials.
11. Arbitration & Governing Law
Any dispute shall be resolved through binding arbitration in Atlanta, Georgia, under AAA Commercial Rules.
All arbitration proceedings will be confidential.
You waive class action rights and agree each claim must be individually resolved.
Judgment on the award may be entered in any court of competent jurisdiction.
These Terms are governed by the laws of the State of Georgia, USA.
Unauthorized commercial use, resale, or redistribution of Arcus Dein materials constitutes material breach. Arcus Dein reserves all remedies under 17 U.S.C. § 504, including:
(a) Actual damages and infringer's profits;
(b) Statutory damages: $750-$30,000 per work, or up to $150,000
for willful infringement;
(c) Attorney fees and costs;
(d) Injunctive relief.
Each unauthorized use of a distinct design constitutes separate
infringement.
Claims Limitation: You must bring any claim within one (1) year from the date it arises, or it will be permanently barred. This shortened period modifies Georgia's standard four-year statute and is a material term of this agreement.
12. Amendments
Arcus Dein may update these Terms periodically. Revised versions will be posted on arcus-dein.com with an updated effective date.
13. Severability
If any provision is held invalid, illegal, or unenforceable, such
provision shall be severed and remaining provisions continue in full force and effect.
