1. Overview
These Licensing Terms (“Terms”) define the rights granted to purchasers (“Licensees”) of digital architectural plans, drawings, and related design files (“Materials”) from arcus-dein.com. By purchasing or using any Material, you agree to these Terms and our Terms of Service.
2. Nature of License
All Materials are protected by copyright. Purchasing any plan or digital file does not transfer ownership of the intellectual property. Arcus Dein LLC (“Licensor”) grants Licensee a limited, non-exclusive, non-transferable license as defined below.
This license grants usage rights only; it does not convey ownership or authorship.
License becomes effective upon full payment.
3. License Categories
Arcus Dein offers the following license options:
1) Single-Use License: Design may be used for one project and one structure only. Most common license for individual clients or builders.
2) Multi-Use License (≤3 Builds): Design may be used for up to three structures on separate sites. Must purchase upgrade from Arcus Dein before reuse.
3) Unlimited-Use License Allows unlimited construction of the same design. Available only under written contract and approval.
International users consent to the jurisdiction of Georgia, USA.
4. General Restrictions
Regardless of license type, Licensee may not:
1) Reproduce, resell, sublicense, or redistribute Materials to third parties.
2) Post or upload Materials to public repositories, resale marketplaces, or AI training datasets.
3) Modify, reverse-engineer, or create derivative works except as noted in Section 5.
4) Use any Material as a permit, construction, or stamped/sealed drawing without local professional review.
5) Claim authorship or remove Arcus Dein copyright marks, metadata, or watermarks.
5. Modifications & Adaptations
Licensed professionals may modify drawings for local code, structural, or environmental adjustments, provided:
- Arcus Dein gives prior written authorization.
- Modifications comply with local laws, and the modifying professional assumes full liability.
- The resulting file remains subject to Arcus Dein’s copyright.
Arcus Dein assumes no responsibility for alterations or field adjustments.
Unauthorized modification or derivative creation terminates the license immediately.
6. Duration
The license is perpetual for the approved project(s) unless revoked for breach. License automatically terminates upon violation of these Terms.
Unauthorized commercial use, resale, or redistribution of Arcus Dein materials constitutes material breach. Arcus Dein reserves the right to recover statutory damages, legal costs, and an administrative penalty of up to fifteen (15) times the original license fee per occurrence.
7. Transfer & Assignment
License is personal to Licensee and non-transferable. Any transfer, sale, or sublicense without prior written consent is void.
8. Audit Rights
Arcus Dein reserves the right to request proof of use, project address, or build documentation to confirm compliance with license scope. Refusal to provide documentation upon request constitutes breach of license.
9. Attribution
If a licensed plan or rendering is publicly displayed (online or in print), the Licensee must include:
“Design Concept by Arcus Dein LLC” in visible form.
10. Liability & Warranty
Arcus Dein provides Materials “as is.” We make no warranty for accuracy, completeness, or code compliance. Licensee assumes all responsibility for verifying dimensions, load paths, and local requirements before construction.
11. Termination
Arcus Dein may suspend or revoke any license for:
- Unauthorized resale or redistribution;
- File sharing or AI dataset use;
- Modification without permission;
- False representation of authorship or origin.
Termination is immediate upon written notice. Continued use after termination constitutes willful infringement.
12. Refunds
Digital products are non-refundable once delivered unless duplicate or corrupted. Refunds or upgrades (e.g., from single to multi-use) must be requested within 30 days of purchase. Refunds, if applicable, will be processed in USD to the original payment method.
13. Governing Law & Dispute Resolution
These Licensing Terms are governed by the laws of Georgia, USA. Any dispute shall be resolved by binding arbitration under the AAA in Atlanta, Georgia, in English.
